1. Definitions

• "User," "You," and "Your" refer to you, the person accessing this website and complying with these Terms.
• "Seller" refers to a User who lists items for auction on the Service.
• "Buyer" refers to a User who bids on items listed for auction.
• "Lot" refers to the item or collection of items listed for auction.
• "Auction" refers to the event or process by which Lots are sold to the highest bidder.

2. Eligibility

You must be at least [18] years old to use our Service. By using the Service, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all of the terms and conditions herein.

3. Account Registration

• To participate in Auctions, you must create an account by providing accurate and complete information.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You agree to notify us immediately of any unauthorized use of your account.

4. Listings and Bidding

4.1. Listings

• Sellers are responsible for ensuring that all information about the Lot is accurate and complete.
• Once listed Sellers must handover the "auctioned items" to a CeylonGemAuctions representitive for verifications and processing prior to the auction is published for public bidding.
• Prohibited items include, but are not limited to, illegal items, counterfeit goods, hazardous materials, and items that infringe on intellectual property rights.
• We reserve the right to remove any Listings that violate these Terms or are deemed inappropriate.

4.2. Bidding

• Buyers may place bids on available Lots during the Auction period.
• All bids must be higher than the current highest bid by at least the minimum increment specified.
• Sellers have the right to accept the highest bid at the close of the Auction or set a reserve price that must be met before a Sale can occur.

5. Payments and Fees

• Buyers are responsible for paying the final bid amount plus any applicable fees and taxes within 24 hours of winning the bid.
• Payments must be made through the approved payment methods outlined on the Service.
• Sellers will receive payment after deducting our commission fee and any other applicable charges.

6. Shipping and Handling

• CeylonGemAuctions.com will be handling the shipping the Sold Lot to the Buyer within the specified timeframe. Additionally, any required services such as Gemstone certification must becompleted before shipping is innitiated.
• All shipping including any exports or imports will be handled exclusively by CeylonGemAuctions.com or its designated service provoder (s).
• Buyers are responsible for providing accurate shipping information.

7. User Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorized access to any portion of the Service.
• Use automated systems or software to extract data from the Service without permission.

8. Intellectual Property

• All content on the Service, including text, graphics, logos, and images, is the property of ceylongemauctions.com, its principal owners or its licensors and is protected by intellectual property laws.
• You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

9. Disclaimers and Limitation of Liability

• The Service is provided "as is" and "as available" without any warranties of any kind, express or implied.
• We do not guarantee the accuracy, completeness, or reliability of any content or Listings on the Service.
• In no event shall ceylongemauctions.com be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.

10. Indemnification

You agree to indemnify, defend, and hold harmless ceylongemauctions.com, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service.

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other Users or the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka and United States Of America state of Georgia, without regard to its conflict of law principles.

13. Dispute Resolution

Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the Sri Lanka, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Service. Your continued use of the Service constitutes your acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, so that these Terms will otherwise remain in full force and effect and enforceable.
